Boy Awarded £8.26 Million Compensation for Brain Damage

A boy who suffered brain damage at birth has had a settlement of £8.26 million approved at the High Court.

Tristian Blomfield will receive the money as an initial lump sum of £2.23 million plus annual payments of £42,000 each year up to the age of 19 and then £105,000 a year for the rest of his life.

Tristian's claim was for compensation for the injury he suffered after an anaesthetist at Watford General Hospital failed to correctly administer an epidural injection to his mother during his birth. The error caused his mother to suffer respiratory arrest resulting in damage to her brain for which she received compensation four years ago.

Unfortunately, Tristian also suffered brain damage as a result of his mother's injury. He has cerebral palsy affecting all four limbs, with poor motor control and tremor.

Because of his injuries Tristian now requires round-the-clock care, with a carer continually present during waking hours and someone on call in case he needs anything during the night.

The West Hertfordshire NHS Trust apologised for the injury to Tristian and the High Court approved the settlement.

The compensation will make possible the purchase of a suitable home and will also pay for the speech and language therapy, physiotherapy and equipment Tristian needs.
